Recently, a criminal case involving the counterfeiting of EVAPCO's registered trademark has concluded. The Baoshan District People's Court of Shanghai rendered its first-instance judgment, finding that the defendant Wang * Xiang had, without the authorization of the trademark owner, used a trademark identical to EVAPCO's registered trademark on the same type of goods. The court held that the circumstances were serious and convicted the defendant of the crime of counterfeiting a registered trademark. The defendant was sentenced to one year and two months' imprisonment, suspended for one year and two months, and fined RMB 110,000.
